Terms of Service

Welcome to Glowy, operated by Glowy LLC ("Glowy," "we," "us," or "our"). Glowy is a mobile application and web platform that enables glassybaby collectors to catalog, track, and manage their collections. Glowy is published on the Apple App Store under the listing name "myGlowy." These Terms of Service ("Terms") govern your use of Glowy regardless of how you access it. By accessing or using Glowy, you agree to be bound by these Terms. If you do not agree, do not use the app.

1. Eligibility and Accounts

You must be at least 13 years of age to use Glowy. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. By creating an account, you agree to provide accurate, current, and complete information and to keep your login credentials secure. You are responsible for all activity that occurs under your account.

2. Description of Service

Glowy provides tools for Glassybaby collectors, including:

• Collection tracking: catalog the votives you own, including quantities and purchase information
• Browse catalog: search and discover Glassybaby products using publicly available product data
• Wishlist: save votives you want and share your wishlist with friends and family
• Community catalog: contribute information about discontinued or unlisted votives
• Social feed: share photos of your collection and interact with other collectors
• Photo identification: use AI-assisted tools to identify votives by color family
• Gift tracker: record votives given to others

We may add, modify, or discontinue features at any time.

3. User-Generated Content

Glowy allows you to upload photos, submit community catalog entries, create social feed posts, and contribute other content (collectively, "User Content"). You retain ownership of your User Content. However, by uploading or submitting User Content to Glowy, you grant us the following license:

This license continues even if you stop using Glowy, to the extent your User Content has been shared with other users, incorporated into the community catalog, or used to train our AI systems. You may delete your individual posts and photos from the social feed at any time, and we will remove them from public display within a reasonable time, but cached or archived copies and AI training data derived from your content may persist.

You represent and warrant that: (a) you own or have the necessary rights to submit your User Content; (b) your User Content does not infringe the intellectual property or privacy rights of any third party; (c) your photos depict products you own, have owned, or have permission to photograph; and (d) your User Content does not contain false, misleading, defamatory, or unlawful material.

4. Community Guidelines for Photos and User-Submitted Media

Glowy allows you to upload photos in three contexts: (a) your profile photo (the avatar displayed on your account and attached to your social feed posts), (b) Inspiration feed posts (photos you share with the community showing your collection, styling, or other glassybaby-related content), and (c) community catalog submissions, including submitting a better or replacement photo for an existing glassybaby votive in the Browse catalog or your Collection. These Community Guidelines apply to all photos you upload in any of these contexts, and are incorporated by reference into these Terms. Violations may result in content removal, account suspension, or account termination, at our sole discretion.

4.1 Photo Content Rules

You may only upload photos that comply with all of the following rules:

Your own content. You must be the creator of the photo or have the legal right to upload it. Do not upload photos taken by other people, copied from websites, social media, retailers, catalogs, or any other source you do not own or have permission to use. Do not upload photos that contain watermarks, logos, or copyright notices belonging to third parties.

No other people without consent. Do not upload photos that show identifiable individuals (including family members, friends, children, or bystanders) unless you have their explicit permission, and unless, in the case of minors, you are their parent or legal guardian and have consented on their behalf. Do not upload photos of children under 13 under any circumstances, even if you are their parent or guardian, as our service is not intended to host images of young children.

No sensitive backgrounds or personal information. Take care not to upload photos that reveal personal or sensitive information, including but not limited to: home addresses, license plates, credit cards, identification documents, medical information, or screens displaying personal messages or accounts. Glowy will remove such content when identified and may notify you so you can re-upload a cropped or edited version.

No offensive, harmful, or unlawful content. You may not upload photos that are sexually explicit, sexually suggestive, violent, graphic, threatening, harassing, discriminatory, hateful, or that promote illegal activity. You may not upload photos depicting weapons, drugs, or drug paraphernalia, even incidentally in the background of a glassybaby photo. You may not upload photos that promote self-harm, suicide, eating disorders, or other harmful behaviors. You may not upload photos that could reasonably be considered obscene under applicable law.

No misrepresentation. You may not upload photos that misrepresent the identity, condition, authenticity, or provenance of a glassybaby votive, particularly when submitting to the community catalog or as a "better photo" replacement for an existing listing. You may not use AI-generated or digitally fabricated images and represent them as genuine photographs of real glassybaby votives in your possession or available in the catalog.

No commercial, promotional, or spam content. You may not upload photos primarily intended to advertise or promote goods, services, businesses, websites, social media accounts, giveaways, or fundraisers, whether your own or another party's. You may not upload photos containing overlaid advertising text, QR codes, or promotional URLs.

No intellectual property infringement. You may not upload photos that prominently feature copyrighted characters, artwork, logos, brand imagery, or other intellectual property belonging to third parties, except where such elements appear incidentally or where you have rights to display them. This includes respecting the intellectual property of glassybaby LLC — photos of glassybaby votives you own are permitted, but photos copied from glassybaby.com, glassybaby marketing materials, or glassybaby's social media accounts are not.

4.2 Profile Photo Rules

In addition to the rules in Section 4.1, profile photos must depict your face, a likeness you have the right to use, or a symbol, object, or image that is appropriate as a public identifier. Profile photos are visible to all Glowy users whenever you post in the Inspiration feed, appear in the community catalog, or share your collection or wishlist. You may not use a profile photo that impersonates another real person, a public figure, a fictional character owned by a third party, or the Glowy or glassybaby brands.

4.3 Inspiration Feed Photo Rules

Photos in the Inspiration feed should be relevant to the glassybaby community — for example, photos of your collection, your votives displayed in your home, styling ideas, gift-giving moments, seasonal arrangements, or other glassybaby-related content. Off-topic photos may be removed at our discretion. Captions accompanying Inspiration feed posts are subject to the same rules as photos and must not contain prohibited content, including but not limited to harassment, hate speech, personal attacks, or commercial promotion.

4.4 Community Catalog and "Better Photo" Submission Rules

When you submit a photo to the community catalog (either as a new entry or as a better/replacement photo for an existing glassybaby), the photo must clearly and accurately depict the specific votive being cataloged. The votive should be the primary subject of the photo, ideally against a neutral or uncluttered background. You may not submit photos of a different votive and misattribute it to a listing. Community catalog photos are held to a higher standard of accuracy than Inspiration feed posts because they become a shared reference resource for all Glowy users.

4.5 Reporting and Enforcement

If you encounter a photo that violates these Community Guidelines, you may report it through the in-app reporting flow or by contacting us at support@myglowy.app. We will review reports in a reasonable timeframe and take action we deem appropriate, which may include removing the content, warning the user, suspending the user's ability to upload photos, or terminating the user's account. We do not guarantee that all reported content will be removed, and we reserve the right to exercise editorial discretion in borderline cases.

We may also proactively remove content that we identify as violating these guidelines, whether through automated tools, manual review, or otherwise, without prior notice to the uploading user. We are not obligated to pre-screen user-uploaded content, but we reserve the right to do so.

Repeat violations. Users who repeatedly violate these Community Guidelines will have their accounts suspended or terminated. "Repeatedly" means, generally, three or more substantiated violations within a twelve-month period, but we reserve the right to terminate accounts for a single severe violation (for example, upload of content depicting minors in violation of Section 4.1, content that infringes third-party intellectual property rights for which we receive a DMCA notice, or content that is unlawful under applicable law).

Appeal. If your content is removed or your account is suspended and you believe the action was taken in error, you may appeal by emailing support@myglowy.app with the subject line "Content Removal Appeal." We will review appeals in a reasonable timeframe and respond with our decision, which is final.

4.6 Acknowledgment at Upload

Each time you upload a photo through Glowy, you will be presented with a summary of these Community Guidelines and asked to acknowledge that your upload complies with them. Your acknowledgment constitutes a representation and warranty that the photo you are uploading satisfies these rules. False acknowledgments — uploading content you know violates these guidelines — constitute a material breach of these Terms and may result in immediate account termination and, where applicable, referral to law enforcement.

5. Prohibited Conduct

You agree not to:

• Upload content you do not own or have rights to use
• Upload content that is offensive, harassing, threatening, or violates any law
• Misrepresent the identity, condition, or provenance of any votive in the community catalog
• Attempt to access other users' accounts or private data
• Use automated tools to scrape, crawl, or extract data from Glowy
• Use Glowy for any commercial purpose other than personal collection management, unless expressly authorized
• Interfere with or disrupt the integrity or performance of the platform
• Reverse engineer, decompile, or disassemble any part of the Glowy application

6. Third-Party Content and Data

Glowy displays product information, including names, descriptions, and pricing, sourced from publicly available data. This information is provided for identification and collection-tracking purposes only.

Accuracy disclaimer: Product information displayed in Glowy, including prices and availability, may not reflect current data from any retailer. Glowy does not guarantee the accuracy, completeness, or timeliness of any product information. Always verify product details directly with the retailer before making purchase decisions.

Glowy is not a retailer and does not sell Glassybaby products. Links to external retailer websites are provided for your convenience and do not constitute an endorsement or affiliation.

7. Intellectual Property

The Glowy app, including its design, code, logos, brand elements, and original content, is owned by Glowy and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Glowy platform without our prior written consent.

User Content remains the property of the respective users, subject to the license granted in Section 3.

Third-party trademarks, including "Glassybaby," referenced within the app are the property of their respective owners. Their use within Glowy is solely for identification and informational purposes and does not imply any affiliation, endorsement, or sponsorship.

8. AI-Powered Features

Glowy uses artificial intelligence to provide photo identification and other features. AI features are provided on an "as-is" basis. AI-generated results, including color family identification and product suggestions, are approximations and may not be accurate. You should not rely solely on AI features to determine the identity or value of any votive.

By using AI features, you acknowledge that photos you submit for identification may be processed by third-party AI service providers. We select providers with appropriate data handling practices, but Glowy is not responsible for the data practices of third-party AI providers beyond our contractual agreements with them.

9. Privacy

Your use of Glowy is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using Glowy, you consent to the data practices described in the Privacy Policy.

Key data practices relevant to these Terms: your collection data, wishlist, and gift records are private by default and only shared when you explicitly enable sharing features. Community catalog contributions and social feed posts are visible to all authenticated users.

10. Shared Collections and Wishlists

Glowy allows you to generate shareable links for your collection and wishlist. When you enable sharing, anyone with the link can view the shared content without needing a Glowy account. You are responsible for controlling who you share these links with. You can disable sharing at any time from your profile, which will immediately deactivate existing share links.

11. Limitation of Liability

GLOWY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLOWY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF GLOWY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Glowy and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of Glowy; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another person or entity.

13. Dispute Resolution

You and Glowy agree to resolve any disputes arising from or related to these Terms or your use of Glowy through binding individual arbitration, except that either party may bring claims in small claims court if eligible. Arbitration shall be conducted under the rules of the American Arbitration Association. You agree to waive any right to a jury trial and to participate in a class action.

Before initiating arbitration, you agree to first contact us at support@myglowy.app to attempt to resolve the dispute informally. If we cannot resolve the dispute within thirty (30) days, either party may proceed with arbitration.

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles.

14. Termination

You may stop using Glowy at any time. We may suspend or terminate your access at our discretion if we believe you have violated these Terms, with or without notice. Upon termination, your right to use Glowy ceases immediately. Sections 3 (User Content license), 4 (Community Guidelines), 7 (Intellectual Property), 11 (Limitation of Liability), 12 (Indemnification), 13 (Dispute Resolution), and 15 (DMCA Policy) survive termination.

15. Copyright Infringement / DMCA Policy

Glowy respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement that are reported to our designated agent.

Reporting Copyright Infringement

If you believe that content available on Glowy infringes your copyright, please submit a notice to our DMCA Designated Agent containing the following information:

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
2. Identification of the copyrighted work claimed to have been infringed.
3. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (e.g., a description of where the content appears in the app).
4. Your contact information, including your name, address, telephone number, and email address.
5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement, made under penalty of perjury, that the above information is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.

Counter-Notification

If you believe your content was removed by mistake or misidentification, you may submit a written counter-notification to our DMCA Designated Agent containing: (a) your physical or electronic signature; (b) identification of the material removed and the location where it appeared before removal; (c) a statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification; and (d) your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court in your judicial district and that you will accept service of process from the person who filed the original complaint.

Repeat Infringers

Glowy will, in appropriate circumstances, disable and/or terminate the accounts of users who are repeat infringers of third-party copyrights.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by other reasonable means. Your continued use of Glowy after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using Glowy.
